Gang-rape - The victim was disembowelled with a blunt object, possibly by
hand, leaving over a metre of her small intestines protruding from
her vagina
Anene Booysen (October 30, 1995 - February 2,
2013) was a 17-year-old girl who was found by a security guard the
morning after she had been gang-raped and disemboweled by having
her abdomen slit open at a construction site in Bredasdorp, in the
Western Cape, South Africa on February 2, 2013; she was still
alive, but died later in the day.
Rape and murder
Anene Booysen was found by a security guard
lying a short distance from her house after partying at a bar on
the evening of February 1, 2013. She died from her injuries in
hospital six hours later. She managed to identify one of her
attackers before her death.
Reaction
South Africa's President Jacob Zuma has
condemned the attack as "shocking, cruel and most inhumane". The
Congress of South African Trade Unions (Cosatu), South Africa's
biggest labour union, called for mass action over rape in South
Africa. Opposition parliamentary leader Lindiwe Mazibuko called
for parliamentary hearings. The United Nations issued a statement
strongly condemning the rape and murder. On 13 February, a
protest, led by Annie Lennox, was staged at St. George's
Cathedral, Cape Town.
Booysen and Reeva Steenkamp, both young South
Africa women killed in 2013, were named SA Persons of the year
2013 by Daily Maverick.
Funeral
A funeral was held at the Dutch Reformed Church
in Bredasdorp, about 128 km east of Cape Town on February 9, 2013.
Prosecution
Johannes Kana was convicted for the crime, and
sentenced to two consecutive life sentences.
Anene Booysen's death in February caused
widespread anger over violence against women in South Africa, with
president Jacob Zuma calling the attack "shocking, cruel and most
inhumane".
She was found at a construction site near her
home in Bredasdorp in the Western Cape by a security guard. She
had been raped and mutilated and died six hours later in hospital.
Initially two men were arrested for the attack
but one, her ex-boyfriend Jonathan Davies, later had all charges
against him dropped.
The other accused Johannes Kana admitted, in
his trial at Swellendam Circuit Court, to leaving the pub with
Booysen on the night of the attack. He hit her and raped her but
denies murder. "I pulled down her pants ... kicked her ... and
raped her," he said in a statement.
The doctors treating Booysen described her
horrific injuries to the jury at the trial.
According to Eyewitness News, Dr Elizabeth De
Kock, who was first to attend to Booysen when she was brought into
hospital, said her injuries were the worst she had ever seen and
that she could not have been saved due to the massive injuries
sustained to her intestines.
She said she was covered from head to toe in
sand and blood and had bruises all over her body. She said a sharp
object had been used to mutilate her genitalia and that her
intestines may have been pulled from her vagina by hand.
Kana reprimanded
De Kock added that she could not tell if the
injuries had been cause by more than one person - it was initially
believed Booysen had been gang raped before her death.
Pathologist Karisha Quarrie, who examined
Booysen's body after her death, said the cause of death was her
mutilated genital area: "All injuries were consistent with a blunt
object such as a brick, baseball bat or stick," South Africa's
Times Live newspaper reported.
She said there were signs of accelerated
decomposition to her intestines and excessive damage to her anus
wall, indicating a great deal of force was used: "The intestines
appeared to have already died while she was alive.
"The large intestines, which are attached to
the stomach wall, were still inside the body but 1.2m of the small
intestines were outside the body through the vagina."
While presenting their evidence, Kana was
reprimanded by the judge for showing little interest in the
details of Booysen's injuries.
Swellendam Circuit Court interpreter Aubrey
Jonase, who was translating the case into Afrikaans on Kana's
behalf, said: "He is not even listening. What is the point if he
is not listening?"
Speaking to the accused, Judge Goliath said: "Mr
Kana, would you please show some enthusiasm and appreciation?"
So far 15 of the 52 witnesses have testified at
the trial, which is expected to finish by the end of October. If
found guilty, Kana faces life imprisonment.
Investigating officer Warrant
Officer Edmund Abels told the Bredasdorp Magistrate’s Court on
Tuesday that Johannes Kana, 21, would not be applying for bail as
he confessed to raping and assaulting Anene.
Outside court, NPA spokesman Eric Ntabazalila confirmed that Kana
confessed to his part in the crime and that witnesses had seen him
with Anene on the night of her murder.
Booysen
was found on February 2, gang-raped and disembowelled, at a
construction site not far from her home.
“He
confessed his involvement in the crime and forensic tests are
being carried out on his clothing and shoes. The State are still
awaiting the results.”
Co-accused Jonathan
Davids, 22, pleaded not guilty and his bail application began on
Tuesday in a packed courtroom.
Police cordoned
off the road leading to the court. There was also a heavy police
presence inside court.
Davids took the stand and
said he had been to the same pub as Anene on the night of her
murder, but had only greeted her.
He said he left the pub with friends and went
home. Once there he went to buy a box of wine and then drank it
with his friends, before going to bed.
“I knew Anene very well and used to live with
them for four to five months. My nickname is Zwai.”
Anene had allegedly uttered the name Zwai
before she died.
Under cross-examination he said he’d heard of
another person with the same nickname. “I heard that he is a 28’s
gangster and lives in the Zwelitsha township, but I don’t know
him.”
When prosecutor Maria Marshall asked him about
scratch marks on his arm and neck on the day he was arrested he
said he had fallen.
Davids told the court that he should get bail
because he was not guilty.
Abels said Anene had pointed out Zwai as the
perpetrator.
“Before she died she told three different
medics that it was Zwai and his friends. And according to Anene’s
mom, Zwai… is the only Zwai she had known. Davids lived with the
family and according to her foster mother was like a child in the
house. He lived with them at one stage.”
Abels said police could not rule Davids out as
a suspect, and that possible blood and semen were found on his
shoes and trousers.
Defence attorney Pieter Du Toit, Abels said he
wasn’t sure whose clothes the semen and blood were found on.
“At the moment there is a strong case against
the accused. We are waiting for the forensic results and can’t say
whose clothes it was found on,” said Abels.
The court heard that Davids had a previous
conviction from 2005 for theft, for which he received a suspended
sentence of five years.
Also, three cases of assault had been brought
against him, but had been withdrawn. Two of the cases had been
opened by men and the third by a woman.
Cross-examined about another man with the
nickname “Zwai”, Abels said police had searched for him. “We were
told he left the area a month before the incident.”
However, he admitted police had searched for
the second “Zwai” for only 30 minutes.
He also admitted that the only thing linking
Davids to the case was his nickname and possible evidence on his
clothes.
