BROWN, PHILLIP, DOB 8-31-80, on January 12, 2001, the Kentucky State Police received a call reporting a death inside the city limits of Columbia, Adair County, KY.  Upon arrival at the scene the investigator found the body of Sherry Bland. Ms. Bland appeared to have been beaten with a blunt instrument and stabbed. After leaving the scene and interviewing witnesses it was learned that a 27" color television was missing.

On August 13, 2002, Phillip Brown was indicted on case 02CR00101, charging him with Murder, first-degree burglary and first-degree robbery. Brown was arraigned on September 15, 2002. 

On November 12, 2003 he was sentenced to life without the possibility of parole for a period of 25 years on the charge of murder, 15 years on the charge of first-degree burglary, and 10-years on the first-degree robbery charge. The 15-year sentence and the 10-year sentence were to be served consecutively, for a total of 25 years, but concurrently to the life sentence.

The case was appealed. A change of venue was granted transferring the case from Adair Circuit to Warren Circuit Court.  On May 12, 2006 the Jury returned the verdict of guilty on the charge of murder, and recommended Death.  The jury returned a verdict of guilty on the charge of first-degree burglary and recommended a sentence of 20 years.  They also returned a guilty verdict on the charge of first-degree robbery and recommended 25 years.  The burglary and robbery charges were ordered to be served consecutively with each other.

On August 19, 2006 Brown was sentenced to Death for murder. He was also sentenced to 20 years for each of the robbery and burglary charges, to be served consecutively for a total of 40 years.

Prosecution’s case/defense response:  Sherry Bland was beaten and stabbed to death in her apartment over a color television.  Brown was convicted of her murder in 2003, and received a life sentence without parole for at least 25 years.  He was also found guilty of robbery and burglary.  On appeal after the Kentucky Supreme Court threw out the conviction, the case was moved from Adair to Warren County, and the jury returned a guilty verdict, with a recommendation of death.
